Congratulations to WHW Partner Jake Gardener and the team on an important victory in their “ghost network” litigation against Blue Shield of California and Magellan Health.  This case concerns the defendants’ alleged misrepresentations regarding their provider network.

The defendants moved to dismiss all of the claims brought by the plaintiffs. The court allowed nine claims to proceed, including claims for breach of contract, unfair competition, intentional and negligent misrepresentation, unjust enrichment, and violations of ERISA.

Jake told Law360:

“The decision makes clear that lying to insurance plan members about the size of their plan’s provider network and the accessibility of their mental health benefits constitutes a violation of defendants’ statutory, contractual, and common law obligations. We look forward to litigating this case to completion and holding Defendants accountable.”
